STEEL PIER WARRANTY
This document explains our method of foundation repair. In no way does
it constitute a contract. Should you desire to retain TFCS, Inc. to a
repair your foundation, we will then present to you a formal contract
setting forth in more detail the specifics of our agreement.
Our piers are specifically designed to function in the metroplex soils
(expansive clay). A 2-7/8" steel pier is pushed until a 5,000 PSI driving
force is obtained, or we reach bedrock. All masonry at the lift areas will
be tuckpointed (i.e., cracks are re-mounted). Soils are then placed back
and sloped away from the foundation.
OUR GUARANTEE TO YOU
LIFETIME LIMITED WARRANTY
The work to be done as set out in our contract for steel pier
correction is guaranteed by the manufacturer, Earth Contract Products,
L.L.C., for a period of twenty five years from the date of installation
against any defects in the manufacturing and workmanship of the Steel
Pier.
The repairs shall be guaranteed against defects in workmanship and/or
materials for a period of 72 months (6 years). Should 1/4" or more
settlement occur in the area where correction work has been performed
during the initial six year period following installation as confirmed by
either a TFCS, Inc. representative or a structural engineer approved by TFCS, Inc. TFCS. Inc. agrees to adjust on existing piers as necessary at no
additional expense to customer or new owner. This warranty is in addition
to the Manufacturer's Twenty Five Year Product Warranty.
NOTE: This warranty does not include sheetrock, masonry or concrete
flatwork repair. It may be necessary to remove concrete flatwork to
properly access piers. These services are chargeable to the owner and the
cost for this work will be made known and agreed upon by both owner and
contractor before the work is to begin.
EXTENDED LIFETIME WARRANTY
Should 1/4" or more settlement occur to repaired areas due to defects
in workmanship and/or material after the expiration of said 72 months (6
year period) has expired, such settlement confirmed by a TFCS, Inc.
representative or a structural engineer approved by TFCS, Inc., TFCS Inc.
will adjust on existing piers as necessary for a price agreed upon by
contractor and owner before adjustment is made. TFCS. Inc. hereby agrees
that the price for such adjustments will not exceed twenty (20) percent of
the original contract price stated above, per adjustment. See "Note"
above.
Exceptions from the coverage of our guarantee as set out in our
contract shall be any movement that occurs as a result of excessive water,
severe wind, other acts of God, and/or major structural renovation. Other
exceptions from coverage by this guarantee shall be movement that occurs
as a result of the owner's negligence or failure to take the necessary
steps to correct specific problems as so designated by TFCS, Inc. Owner is
responsible for gutter downspouts to be extended away from the foundation
and the proper backfilling and sloping of soil away from the perimeter of
the foundation. Pier and beam wood floor system repairs are excluded from
this warranty. All underneath work (shimming of floors, wood repairs,
etc.) on pier and beam foundation is excluded from such guarantees noted
above. These guarantees are exclusive and there are no understanding
agreements, representation or warrants, expressed or implied (including
any regarding marketability or fitness for a particular purpose) not
specified herein, made by TFCS, Inc. with respect to this contract or the
services performed hereunder. This contract states the entire obligation
of TFCS, Inc. in connection with this transaction. TFCS, Inc. disclaims
any and all liability for special direct, indirect, incidental, or
consequential damages, arising from this contract, including without
limitation, loss of profits and damage to other property or persons. This
warranty is transferable in the event of sale of the structure. All
guarantees will remain in place. |
